Legal Notice ORDINANCE AMENDING THE CODE OF CHAPTER 55 OF THE GLOUCESTER CITY HOUSING CODE, ARTICLE I, CHAPTER 55-13C (1), CERTIFICATE OF OCCUPANCY WHEREAS, it has been found and declared that there exists in the City of Gloucester City (“City”) buildings or parts thereof, which are so old, dilapidated or have become so out of repair as to be dangerous, unsafe, insanitary or otherwise unfit for human habitation. There occupancy or use are inimical to the welfare and dangerous and injurious to the health and safety of the people of the municipality and a public necessity exists for the repair, closing or demolition of such buildings or parts thereof; and WHEREAS, the New Jersey Uniform Fire Code (“NJ UFC”) was amended on July 1, 2018 with an effective date of January 1, 2019, requiring 10-year sealed battery single station smoke alarms be installed where single station smoke alarms with removable battery or when no smoke alarms are present; and WHEREAS, the NJ UFC rules require all single station smoke alarms with removable battery to be replaced regardless of whether they were installed just prior to the enactment of the legislation; and WHEREAS, the Mayor and Common Council of the City have established certain housing standards in the interest of the public’s health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Common Council of the City of Gloucester City, County of Camden and State of New Jersey s: that §55-13C (1) is hereby amended to read as follows: SECTION 1 : §55-13C (1). In addition, a certificate of occupancy shall be issued by the Housing Inspector or Code Enforcement Official upon the certification by the Fire Official, or other duly authorized personnel, of the satisfactory installation of hard wired interconnected battery backup smoke detectors or 10-year sealed battery smoke alarms in proper working order on or near the ceiling of each level of a residential or commercial structure and upon the satisfactory installation of battery operated smoke detectors in proper working order in each bedroom or sleeping area of every residential structure. SECTION 2 : All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency. SECTION 3 : If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any section, subsection, paragraph, subdivision, or clause of this Ordinance. SECTION 4: This Ordinance shall take effect immediately upon final passage and publication in accordance with law. PUBLIC NOTICE AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 43 ENTITLED “DOGS” OF THE CODE OF THE CITY OF GLOUCESTER CITY, COUNTY OF CAMDEN AND STATE OF NEW JERSEY WHEREAS, the City of Gloucester City (“City”) is a municipal corporation organized and operating under the laws of the State of New Jersey; and WHEREAS, pursuant to N.J.S.A. 40:48-2, the Governing Body is authorized to enact and amend ordinances as deemed necessary for the preservation of the public health, safety and welfare and as may be necessary to carry into effect the powers and duties conferred and imposed upon the City by law; and WHEREAS, pursuant to N.J.S.A. 40:41A-28, municipalities under the general law of the State of New Jersey may employ services and facilities for more effective, efficient, and adequate provision of services, if and when municipalities may deem it desirable to do so, and municipalities are and shall remain the broad repository of local police power in terms of the right and power to legislate for the general health, safety and welfare of their residents; and WHEREAS, pursuant to 40A:14-152., entitled: “Members and officers shall have powers of peace officers and constables”, members and officers of a police department and force, within the territorial limits of the municipality, shall have all the powers of peace officers and upon view, may apprehend and arrest any disorderly person or any person committing a breach of the peace and said members and officers shall have the power to serve and execute process issuing out of the courts having local criminal jurisdiction in the municipality and shall have the powers of a constable in all matters other than in civil causes arising in such courts; and WHEREAS, the Mayor and City Council of the City of Gloucester City desire to amend Chapter 61A of the Code of the City of Gloucester City. NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Common Council of the City of Gloucester City, County of Camden and State of New Jersey as follows: Section 1 : § 61A-7 Jurisdiction, violations and penalties, shall be amended to read as follows: Any person who commits a breach of the peace while committing a violation of this chapter shall be subject to arrest according to N.J.S.A. 40A:14-152. Officers and others authorized to enforce these provisions, shall consider the time, place, and circumstances while determining if the act is a breach of the peace. Any person who shall violate this chapter shall, upon conviction thereof, pay a fine not exceeding $500 or be imprisoned in the county jail for a term not exceeding 90 days, or both, for each offense in the discretion of the court. Section 2 : All prior ordinances inconsistent with this ordinance are repealed only to the extent of such inconsistency. Section 3: If any section, subsection, paragraph, sentence or other part of this Ordinance is adjudged unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder of this Ordinance, but shall be confined in its effect to the section, subsection, paragraph, sentence or other part of this Ordinance directly involved in the controversy in which said judgment shall have been rendered and all other provisions of this Ordinance shall remain in full force and effect. Section 4 : This Ordinance shall take effect immediately upon final adoption and publication in the manner prescribed by law.
