It is designed to feature a 6ft high privacy lattice at its edge on the side of 167 John street and complies at that (southern) side with the permitted 4 ft. setback (it is at 4.8 ft). The northern side (neighboring 171 John st.) is at 4.1 ft. requiring variance approval from 8 ft. at the wall of the house when the 4ft side yard exception is applied. The setback widens to the approved 8 ft midway (at about 4 ft. from the house). It has stairs that comply with the setback requirements on both sides. The northern facing setback variance for the rear deck is required to accommodate the space required to safely enter and exit the house. Only a foot separates the rear door from the edge of the deck at the southern (complying) side. The subject lot itself is non-complying with respect to the following bulk requirements: Lot width: required-60 ft/ existing-18.5 ft. Lot area: required-6,000 ft/ existing-2312.5 sf.
