R.S. 40:55D, 11 & 12) NOTICE Notice is hereby given that on September 25, 2024 at 7:30 P.M., the Princeton Zoning Board of Adjustment will hold a virtual meeting at which a hearing on the application of the undersigned, at which time and place all interested persons will be given an opportunity to be heard. Location of premises: 169 John Street, Princeton, Block 17.03, Lot 95, R 4-B Zone Nature of application: Variance required: Larger side yard setback: Required 8 ft/ proposed 4.1 ft. Section 17A-403 (1) (2) (f) permits exceptions to side yard setbacks as follows: Non-enclosed one-story porches, porticos, stoops, entrance platforms, uncovered decks and basement entrances may project not more than four feet into a side or rear yard setback A C-1 Variance is requested to permit approval of a constructed rear deck/porch exception to the required side yard setback on the northern side (neighboring 171 John st), owing to the narrowness of the lot width and area. A preexisting deck and stairs were replaced by a slightly larger deck and stairs that serve as the principal means of entrance to the home. The new 76 sqf trapezpoidal shaped deck narrows to an approved width as it moves away from the house. It is designed to feature a 6ft high privacy lattice at its edge on the side of 167 John street and complies at that (southern) side with the permitted 4 ft. setback (it is at 4.8 ft). The northern side (neighboring 171 John st.) is at 4.1 ft. requiring variance approval from 8 ft. at the wall of the house when the 4ft side yard exception is applied. The setback widens to the approved 8 ft midway (at about 4 ft. from the house). It has stairs that comply with the setback requirements on both sides. The northern facing setback variance for the rear deck is required to accommodate the space required to safely enter and exit the house. Only a foot separates the rear door from the edge of the deck at the southern (complying) side. The subject lot itself is non-complying with respect to the following bulk requirements: Lot width: required-60 ft/ existing-18.5 ft. Lot area: required-6,000 ft/ existing-2312.5 sf. The existing house is non-complying regarding the following bulk requirements: Smaller Side Yard setback: required-8 ft / existing-0.0 ft. Combined Side Yard setback: required-20 / existing-1.8 ft. Height to Setback ratio: required-4.5:1 / existing-non-complying Historic Preservation: Although the subject property is located within the Witherspoon Jackson Historic District, Elizabeth Kim, the Historic Preservation Officer, has reviewed the application and advised that the deck/porch is not visible from the public right of way and that no review by the Commission is required. The Applicant will also apply for such other variance relief, exceptions, waivers, permits, approvals, or licenses that are deemed necessary or appropriate by the Applicant or the Board, and which may arise during the course of the hearing process.
