Legal Notice Notice is hereby given that the following Ordinance, numbered #O 27-2024 was passed on first reading at a regularly scheduled meeting of the Mayor and Common Council of Gloucester City held on September 23, 2024, thus AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 4. OF THE ADMINISTRATIVE CODE, ARTICLE X, ENTITLED POLICE DEPARTMENT IN THE CITY OF GLOUCESTER CITY, THE COUNTY OF CAMDEN AND STATE OF NEW JERSEY, TO ADD AND CREATE THE POSITIONS OF CIVILIAN POLICE AIDES AND NON-SWORN AGENTS WHEREAS, the Chief of Police has recommended to the Mayor and Common Council of the City of Gloucester City the creation of certain civilian non-sworn employee positions assigned to perform law enforcement support functions and duties to increase economy and efficiencies within the Gloucester City Police Department; and WHEREAS, the City’s Chief of Police is formulating a policy that provides for the engagement of civilian non-sworn members of the Gloucester City Police Department which shall be referred shall be to as Agents or Police Aides (PA); and WHEREAS, Clerical Personnel, Telecommunicators/Dispatchers, Special Law Enforcement Officers, Interns, or Volunteers shall not be considered Agents or Police Aides; and WHEREAS, Police Aides and Agents shall be required to adhere to certain procedures set forth in policy hereby created and approved by Ordinance. NOW THEREFORE BE IT ORDAINED, by the Mayor and Common Council of the City of Gloucester City in the County of Camden and State of New Jersey as follows: SECTION 1: The Code of the City of Gloucester City, specifically § 4-71, is hereby amended to include the creation of the positions of Civilian Police Aides and Non-Sworn Agent as follows: § 4-71 Civilian Police Aides and Non-Sworn Agents. A. Establishment. The City of Gloucester City authorizes the use of Civilian Police Aides and Non-Sworn Agents to assist the regular Police Department in the performance of its duties and responsibilities, subject to certain eligibility criteria and limitations. All Civilian Police Aides and Non-Sworn Agents shall be appointed by the Mayor and Common Council upon the advice of the Chief of Police to a term not to exceed one (1) year. (1) No Civilian Police Aides and Non-Sworn Agents, by virtue of his/her appointment as such, shall be or become a regular member of the Police Department. (2) Civilian Police Aides and Non-Sworn Agents are considered at-will part-time employees and can be terminated without cause. (3) Civilian Police Aides and Non-Sworn Agents, while on duty, shall abide by all the rules and regulations of the Police Department and those policies, general orders or standard operating procedures established by the Chief of Police. B. Qualifications. (1) No person shall be appointed as a Civilian Police Aide and Non-Sworn Agent unless the person: (a) Is legally permitted to work in the United States; (b) Is a resident of the State of New Jersey during his/her term of appointment; (c) Is able to read, write and speak the English language well and intelligently and has a high school diploma or its equivalent; (d) Is of sound body and of good health; (e) Is of good moral character; and (f) Has not been convicted of any offense involving dishonesty or that which would make him/her unfit to serve as a special law enforcement officer. C. Duties. Duties of the Civilian Police Aides and Non-Sworn Agents shall be determined by the Chief of Police or his/her designee. D. Chain of Command. Civilian Police Aides and Non-Sworn Agents shall be assigned to a Division, Bureau or Unit of the Police Department at the discretion of the Chief of Police. Upon being assigned the Police Aide or Agent will follow the Chain of Command as directed in the Organizational System of the Department. E. Adoption of Policy. All policies, including the Civilian Police Aides and Non-Sworn Agents Policy is hereby codified and approved by Ordinance of the City of Gloucester City. SECTION 2 : All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency. SECTION 3: If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any section, subsection, paragraph, subdivision, or clause of this Ordinance. SECTION 4: This Ordinance shall take effect immediately upon final passage and publication in accordance with law.
